Art market professionals and resale royalties
Art market professionals – auctioneers, dealers, galleries and others in the business of dealing in artworks – have legal obligations under the artists' resale royalty scheme. They are:
- liable (with the seller) to ensure royalties are paid on certain resales
- obliged to respond to requests for information about resales from Copyright Agency
The scheme requires sellers, or their agents, to report all commercial resales for $1,000 or more (whether or not a royalty is payable) to Copyright Agency.

Paying royalties
A royalty is payable on a resale if:
- the work was acquired by the seller after 8 June 2010 (there is no royalty on the first change of ownership after 8 June 2010)
- the sale price (including GST) was $1,000 or more
- the artist is from Australia
